Mableton council could take final vote Monday on 23-acre subdivision off Old Alabama, Cardell and Maxham roads

The Nov. 9 agenda has a public hearing on the David Pearson Communities rezoning, followed by a vote on adopting it. The agenda does not say how many homes are planned or what city staff recommended.

On Monday, Nov. 9, Mableton City Council is scheduled to hold a public hearing on a request to rezone about 23 acres along Old Alabama, Cardell and Maxham roads for a single-family subdivision. The council is then scheduled to consider adopting the rezoning ordinance. The meeting starts at 6:30 p.m. at the Riverside EpiCenter, 135 Riverside Pkwy.

For people who live near the site, this is the meeting where the council can take final action, and it is also their chance to speak. Under the posted agenda, supporters get 10 minutes as a group and opponents get 10 minutes as a group. A separate general public comment period allows 2 minutes per speaker, with a 30-minute limit in total. To speak, fill out a comment card and give it to the City Clerk before the meeting starts.

What the agenda shows

The case is REZ-2026-004. The applicant is David Pearson Communities, Inc., which wants the land rezoned from R-20 and R-20/OSC to RA-5 for a subdivision of single-family detached homes. The site covers about 23.119 acres in District 1, which is represented by Mayor Pro Tem Ron Davis. Community Development Deputy Director Tina Garver is listed as presenting the case.

The agenda does not say how many homes are proposed. It does not include a site plan or state a recommendation from city staff or the Planning Commission.

A separate item on the consent agenda asks the council to ratify "Council member approved elevations" for "Sawmill Creek located near Maxham Road, PIN 18008700190." The agenda does not say whether that item is connected to this rezoning.

How the case got here

WSB Radio reported on Aug. 27 that residents were opposing the project as the council took it up. According to WSB, Kevin Moore, who represents the developer, said townhomes and other developments had already been built along the three roads. WSB also reported that Mayor Michael Owens said the development could help create more affordable housing. Residents raised concerns about traffic, including school traffic near Pebblebrook High School. They also raised flooding, citing homes destroyed in 2005 and 2009. The developer said preliminary floodplain studies had been done for the area.

WSB reported at the time that a final decision was scheduled for Sept. 3. That didn't happen. The Sept. 9 council agenda, as reproduced by the Cobb Courier, listed the case with a "Recommendation to defer to September 30, 2026." It is now back on the Nov. 9 agenda.

What remains unknown

  • How many homes are planned now, and what the current site plan looks like. The Nov. 9 agenda gives neither.
  • What city staff and the Planning Commission recommended. The agenda does not say.
  • Why the case has been pending since September.
  • Whether the Sawmill Creek item has anything to do with this rezoning.
